SECTION 1 – ONLINE STORE TERMS

Thank you for visiting AllTerra Arms.com. Please review the following Terms and Conditions. If you visit or purchase products on this website, you accept these terms. Please read them carefully. We reserve the right to make changes to our site and to these terms and conditions at any time without notice. Your use of the site following any such changes shall confirm your agreement to follow and be bound by the terms as modified.

With any purchase from AllTerra Arms you are confirming and stating that you are a legal adult (18 years or older) and are not a felon or have a Criminal Record. If for any reason law enforcement needs information regarding one of our purchasing parties we will share this information of that persons purchase in cooperation with requests from law enforcement.

WITH ANY PURCHASE YOU CONFIRM AND ATTEST THE FOLLOWING:

  • 1 – You are of legal age to own the item purchased.
  • 2 – You do not have a criminal background.
  • 3 – You are legally allowed to purchase the specified item in your state.
  • 4 – You are not violating any State or Federal Laws with your purchase.
  • 5 – You are not legally prohibited to purchase the items chosen.
  • 6 – You are not involved in criminal activities.
  • 7 – You are not legally banned from owning Firearms.
  • 8 – You are IN COMPLIANCE WITH ANY APPLICABLE ITAR AND EARREGULATIONS.

SECTION 2 – TERMS & CONDITIONS

AllTerra Arms may require as part of this sale the verification of your citizenship status and by doing so may require the purchasing party to provide the following document or documents in order to satisfy this requirement. If requested please send AllTerra Arms a copy of your passport or a birth certificate. If you are in Law Enforcement a photocopy of your badge or identification will also work for valid proof of status.

LAWFUL CITIZEN:

Convicted felons and individuals with criminal records are prohibited from owning a firearm. AllTerra Arms reserves the right to refuse any sale suspected of being ordered by or delivered to convicted felons and suspected criminals or anyone AllTerra Arms perceives as violating federal or state law.

Certain products AllTerra Arms sells require they only be sold or distributed to U.S. persons under federal laws and regulations (See Section regarding ITAR). You must indicate on your order if you intend for an item(s) to be exported. By completing this purchase, you agree that you are a U.S. Person and currently maintain permanent residency in the United States. You further agree that these items are being purchased for personal use and that they will not be redirected or exported without first obtaining permission form the U.S. Government through the U.S. Department of State Directorate of Defense Trade Controls and/or the U.S. Department of Commerce through the Bureau of Industry Security. AllTerra Arms will not participate in any transaction, directly or indirectly, involving the illegal export or re-export of any prohibited items.

PAYMENT METHODS:

AllTerra Arms accepts Visa, Master Card, American Express and Discover credit cards. We utilize a licensed system for credit card authorization. We use industry standard SSL (Secure Sockets Layer) encryption to protect the confidentiality of your personal information. None of this information will be shared with any third parties for any purpose.

ORDER CHANGES:

If you have any questions about your order or if you need to make a change and your order has not yet been started, please call us at 208-608-5179 or by email at info@allterraarms.com. Order changes will increase the build time of your rifle system and will incur a change fee of $100. If you change your optic and AllTerra Arms has already purchased your optic you will be responsible for its cost unless AllTerra Arms is able to return the optic for a full refund.

FFL DEALER

In order to arrange for shipping and transfer a purchaser of a firearm must locate an FFL dealer in their state to complete any firearm purchase. After contacting this dealer and informing them you would like to receive a firearm for transfer, please provide the dealer with the contact information for AllTerra Arms. The dealer will need to supply AllTerra Arms with a copy of their current valid FFL. PLEASE NOTE: it is the responsibility of the purchaser to make arrangements with their selected FFL dealer regarding the transfer requirements including any fees and costs which the dealer may charge. AllTerra Arms is not responsible for dealer-imposed transfer fees or costs.

CANCELING AN ORDER:

If you need to cancel your order, please call 208-608-5179 or e-mail customer support. If the optic you select is not a normal stocked item you will be responsible for the cost of the optic and it will be shipped to you. The 50% Deposit will be used to cover costs of Optic and other accessories that were ordered specific to your build. Any remaining monies from the Deposit will be returned to you minus a 10% re-stocking fee. If your rifle has started the build process the entire 50% Deposit is forfeited and any items that were ordered specific to your build will be shipped to you. If you purchase a Ready To Ship rifle it is only eligible for return based on our stated 3 point guarantee and will follow the RMA process set forth in the AllTerra Arms Guarantee.

FOREIGN SALES:

AllTerra Arms welcomes foreign purchasers; sales outside of the United States require compliance with export regulations. Foreign purchasers need to contact customer support for details regarding export requirements and procedures. Please call 208-608-5179 or e-mail customer support at info@allterraarms.com before placing an order intended for export outside of the United States.

ITAR (INTERNATIONAL TRAFFIC IN ARMS REGULATIONS) INFORMATION:

ITAR (International Traffic in Arms Regulations) and EAR (Export Administration Regulations) Compliance Statement Products purchased from this website may contain items within the definition of 22 CFR Chapter I, Subchapter M – INTERNATIONAL TRAFFIC IN ARMS REGULATIONS part 120 through 130, and may be subject to the export control laws of the U.S.

Under ITAR “defense article” is defined as any item or “technical data” identified on the USML, which is set forth in Part 121.1 of the ITAR. The definition of defense article additionally includes models, mockups, and other physical forms that reveal technical data directly relating to USML items.

These items are controlled by the US government and authorized for export only to the country of ultimate destination for use by the ultimate consignee or end- user(s) herein identified. They may not be resold, transferred, or otherwise disposed of, to any other country or to any person other than the authorized ultimate consignee or end-user(s) either in their original form or after being incorporated into other items, without first obtaining approval from the US government or as otherwise authorized by US law and regulations.

The unauthorized transfer of these products by any method to a foreign person, whether within the U.S. or abroad without the written authorization of the Department of State Directorate of Defense Trade Controls (DDTC), or Department of Treasury Office of Foreign Assets Controls (OFAC) is strictly prohibited by law. (Please see 15 C.F.R., 22 C.F.R., 18 U.S.C., 22 U.S.C., and 50 U.S.C. for additional information)

Under ITAR, export includes the obvious activities of sending or taking any ITAR- controlled commodity or information out of the United States. The term export also includes transferring ITAR-controlled commodities within the United States to anyone not a U.S. citizen or lawful permanent resident (with certain narrow exceptions). Transfers of ITAR controlled commodities or information to non- U.S. employees of U.S. companies entirely within the U.S. are therefore exports under ITAR. ITAR looks at the person’s country of origin (i.e., country of birth) and all current citizenships to determine if an individual is or is not a U.S person. U.S. person means a person (as defined in § 120.14 of this part) who is a lawful permanent resident as defined by 8 U.S.C. 1101(a)(20) or who is a protected individual as defined by 8 U.S.C. 1324b(a)(3). It also means any corporation, business association, partnership, society, trust, or any other entity, organization or group that is incorporated to do business in the United States. It also includes any U. S. governmental (federal, state or local) entity. It does not include any foreign person as defined in § 120.16 of this part.

By ordering any product(s) from AllTerra Arms, you certify that you, or third- party entities at your direction, will not sell, transport, ship or transfer outside the borders of the United States, nor to any foreign person, any product(s) which are export-restricted by U.S. export-control law and regulation, without proper U.S. Government export authorization, licensing, and documentation.

Due to these laws and regulations, AllTerra Arms is required to only sell our products to lawful U.S. persons unless with an approved export license. We therefore use a method to verify proof of citizenship/residency before processing and delivering restricted products. By placing an order on our website, you agree to these requirements and that a request for your passport, birth certificate, and/or other form of identification may be required. Additional documentation may be requested by AllTerra Arms to verify compliance. If you refuse to provide this information your order will be canceled and a full refund will be provided.
